Stalin Calls Presidential Reference a ‘Sinister Intent’ to Weaken State Governments

Tamil Nadu Chief Minister M.K. Stalin has strongly criticized the Union government’s decision to seek the Supreme Court’s opinion on the time frame for Governor’s assent to bills. Stalin believes this move, known as a Presidential Reference, is an attempt to undermine the authority of state governments and the Supreme Court.

In a social media post, Stalin described the situation as “grave circumstances,” urging all non-BJP states and party leaders to join the fight against what he sees as an assault on the Constitution. He argued that the Centre is trying to overturn the Supreme Court’s settled position on the matter, which he believes was already established in the Tamil Nadu Governor’s case.

President’s Reference Raises Concerns

President Droupadi Murmu sent the Presidential Reference to the Supreme Court, asking for its opinion on whether the court can use its inherent powers under Article 142 to set deadlines and prescribe procedures for Governors and the President when dealing with bills from state legislatures.

Stalin believes this move directly challenges the Supreme Court’s authority as the final interpreter of the Constitution. He questions why there would be any objection to imposing time limits for Governors to act, suggesting that the BJP is trying to legitimize delays in bill assent. He further accuses the Centre of aiming to paralyze non-BJP state legislatures.

Stalin’s statement highlights the growing tension between the Centre and state governments on this issue. He views the President’s Reference as a dangerous attempt to weaken the federal structure of India and give the BJP undue control over state affairs.
