Dhankhar Calls for FIR in Justice Varma Case

Vice President Jagdeep Dhankhar has publicly criticized the in-house investigation into allegations against Justice Yashwant Varma, calling it “inconsequential” and lacking both constitutional and legal validity. Dhankhar stressed the urgent need for a formal First Information Report (FIR) to be filed in the case, expressing concern over the lack of transparency and the potential for impunity within the judicial system.

Money Trail and Judicial Integrity

Dhankhar stated, “People are waiting with bated breath… The money trail, its source, its purpose, did it pollute the judicial system? Who are the bigger sharks? We need to find out.” He emphasized the need for a thorough and transparent investigation to uncover the truth and ensure accountability.

Concerns over Delay and Impunity

Dhankhar highlighted the delay in filing an FIR, stating, “Already two months have gone by… investigation is required to be (done expeditiously). So is the case with the registration of an FIR.” He argued that a delay in such a high-profile case undermines the rule of law and public trust in the judicial system.

Revisit K Veeraswami Judgment

The Vice President also called for a re-evaluation of the 1991 K Veeraswami judgment, which requires prior sanction for prosecuting judges. Dhankhar contended that this judgment has created a “scaffolding of impunity” around the judiciary, hindering accountability.

Dhankhar’s Stance and Judicial Reforms

While acknowledging the Supreme Court’s efforts within existing mechanisms, Dhankhar urged for a revisiting of the process to ensure a more robust and effective response to allegations of misconduct within the judiciary. He emphasized the importance of transparency and accountability for the survival of democracy and the public’s trust in the legal system.

Dhankhar Praises CJI Khanna’s Transparency

Dhankhar lauded former Chief Justice of India Sanjiv Khanna for his efforts in enhancing transparency by making documentation public. He expressed hope that the Justice Varma case will serve as a catalyst for further reforms and a stronger commitment to accountability within the judiciary.

Protocol Concerns and National Importance

Dhankhar also echoed the concerns raised by current Chief Justice B R Gavai regarding protocol violations and underscored the importance of upholding protocol for the esteemed position of the Chief Justice of India.
