Trump Administration Turns Civil Rights Enforcement on Its Head

The Trump administration has taken a controversial turn in its approach to civil rights, pivoting from protecting historically marginalized groups to investigating institutions accused of favoring them. This shift has sparked accusations of hypocrisy and a deliberate attempt to undermine diversity efforts.

Targeting Diversity Programs

The administration has launched a series of investigations into organizations accused of prioritizing diversity over merit. These include:

  • Chicago: The Justice Department is investigating the city’s hiring practices, alleging discrimination against non-Black individuals after Mayor Brandon Johnson praised the number of Black people in top city jobs.
  • Chicago Public Schools: The Education Department’s Office for Civil Rights is probing the school system’s “Black Students Success Plan,” claiming it unfairly favors one group of students.
  • Harvard University: The Equal Employment Opportunity Commission (EEOC) is investigating Harvard for allegedly discriminating against white men in hiring and promotion practices, citing declining representation of white men in tenured faculty positions.

Selective Enforcement Raises Concerns

Critics argue that the administration is selectively enforcing civil rights laws, targeting institutions that promote diversity while ignoring complaints of discrimination against minorities, women, and other protected groups.

The EEOC’s investigation into Harvard, in particular, has drawn fire. The agency is using diversity statements and data as evidence, a rare approach, and accusing the university of discriminating based on race and sex. This contrasts with the administration’s recent ban on the use of “disparate impact,” a legal theory that can help determine if policies unintentionally disadvantage certain groups.

Former EEOC officials have called the investigation unjustified, arguing that aspiring to promote diversity is not the same as considering race and gender in individual hiring decisions.

Hypocrisy and Retribution Accusations

The Trump administration’s actions have been widely criticized as hypocritical and retaliatory.

Michael J. Petrilli, a conservative think tank president and critic of disparate impact analysis, stated, “This is obviously hypocritical on its face. Here the administration is using statistics to launch an investigation, and just two weeks ago, they said that they were going to ban this practice. So, which is it?”

Shifting the Focus of Civil Rights

Civil rights experts argue that the Trump administration’s focus on investigating diversity programs distorts the true meaning of civil rights.

Catherine E. Lhamon, former head of the Office for Civil Rights at the Education Department, said, “Civil rights, properly understood, do not pit one group against another but protect all of us.” She added that the administration’s vendetta-driven investigations do not focus on fulfilling Congress’s guarantee of equal protection under the law.
