A Health Insurance Lifeline for Supreme Court Lawyers

Senior Advocate Kapil Sibal, former president of the Supreme Court Bar Association (SCBA), has made a significant move to support the well-being of lawyers practicing in the Supreme Court. He successfully raised Rs 50 crore from prominent industrialists to fund a comprehensive group medical insurance policy for SCBA members.

A Controversial Decision

While Sibal’s initiative has been lauded by many, it has also sparked some debate within the SCBA. Vikas Singh, the newly elected president of the Bar body, has expressed concerns about the cost-effectiveness of the policy and has called for renegotiation or even scrapping it. Singh argues that the premium for a Rs 2 lakh cover is disproportionately high compared to the premium for a Rs 5 lakh cover.

Addressing Concerns of Conflict of Interest

The fact that Sibal received donations from individuals and companies who often appear before the Supreme Court has raised questions about potential conflicts of interest. However, Sibal maintains that there is no conflict as the money is donated to the association and not to any individual. He points out that he frequently represents both these companies and individuals in court and charges them for his services.

A Generous Roster of Contributors

Sibal revealed the names of the generous contributors who helped him raise the substantial sum. These include:

  • Mukesh Ambani (Reliance Industries) – Rs 10 crore
  • Anil Ambani (Reliance Group) – Rs 5 crore
  • Gautam Adani (Adani Group) – Rs 5 crore
  • N Chandrasekharan (Tata Sons) – Rs 5 crore
  • Samir Mehta (Torrent Group) – Rs 5 crore
  • G M Rao (GMR Group) – Rs 5 crore
  • Kumar Mangalam Birla (Aditya Birla Group) – Rs 5 crore
  • Anil Aggarwal (Vedanta) – Rs 5 crore
  • Lakshmi Mittal (ArcelorMittal) – Rs 5 crore

According to Sibal, these donations will be eligible for tax exemption under Section 80G of the Income Tax Act.

A Policy for the Needy

Singh, the new SCBA president, has expressed his intention to ensure that this policy benefits those who need it most. He plans to restrict access to needy members of the Bar or those who support elderly parents, arguing that those with comfortable incomes shouldn’t be entitled to the benefits. He intends to discuss this further with his Executive Committee.

A Vital Support System

Sibal emphasizes that 95% of lawyers practicing in the Supreme Court do not have a regular income and often struggle financially. The policy aims to provide them with much-needed financial security and peace of mind in case of medical emergencies. Chief Justice of India B R Gavai also acknowledged the importance of this initiative, stating that it reflects the SCBA’s deep concern for the welfare of the legal community.
