The Supreme Court has reinstated the 3-year minimum practice requirement for aspiring judges, but with a crucial twist. The ruling, delivered on Tuesday (May 20), clarifies that this new condition won’t apply to judicial recruitment processes already underway in state and high courts.

Essentially, this means the minimum practice requirement will only impact future recruitment processes.

Chief Justice of India BR Gavai announced, ‘Minimum practice requirement shall not be applicable where the High Courts have already commenced the appointment process of Civil Judges Junior Division before the date of this judgment, and this shall be applicable only when the next appointment process begins.’

The court also provided a welcome update for those waiting in the wings. All recruitment processes previously paused due to this legal case can now resume.
