Champak vs. IPL: Trademark Battle Over Robot Dog Name

A legal battle is brewing between renowned children’s magazine Champak and the Indian Premier League (IPL). Champak is suing the IPL for trademark infringement over the name of its new AI robot dog mascot, ‘Champak.’

What’s the Issue?

Champak magazine, published since 1968, claims that the IPL’s use of ‘Champak’ for its robot dog infringes on its registered trademark. They argue it’s a well-known brand and using the name for commercial purposes like the IPL is exploiting their intellectual property.

IPL’s Defense

The IPL, however, maintains that ‘Champak’ is simply the name of a flower and that people associate the robot dog with a character from a TV series, not the magazine.

The Court’s Take

Justice Saurabh Banerjee of the Delhi High Court has asked the BCCI (the body governing the IPL) to respond to Champak’s plea within four weeks. The judge also pointed out that cricketer Virat Kohli’s nickname is ‘Chiku,’ a character in Champak magazine, questioning why no legal action was taken against him. He asked Champak’s lawyer to clarify how the alleged infringement occurred. The court has scheduled the next hearing for July 9.

What’s Next?

The case will now proceed with the BCCI’s response. The outcome will likely have implications for trademark law and brand protection in India, especially in the context of new technologies like AI.
